Terms of Use

These terms apply to your use of shortlistaio.com (the "Site") and of any free report, sample analysis or research that we make available, whether on the Site, by email or otherwise. The Site is operated by Shortlist aio Ltd., a Manitoba, Canada corporation ("Shortlist AIO", "we", "us"). By using the Site, or any free report or research we provide, you agree to these terms. If you do not agree, please do not use them. Paid services are governed by our Master Services Agreement and the applicable statement of work, not by these terms.

1. Using the Site

You may use the Site for lawful purposes. You may not interfere with or disrupt it, attempt unauthorized access to it or to any related system, or harvest email addresses or other contact information from it. Search engines and AI crawlers that follow standard crawling conventions are welcome to index the Site.

2. Free Reports and Sample Analyses

We may send you a free report, sample analysis or similar measurement outside a signed statement of work (a "Free Report"). Each Free Report:

• measures a sample of prompts at a point in time, and because answer engines are non-deterministic, a repeat measurement will differ;
• reproduces or summarizes answers generated by third-party AI systems that we do not control, and quoted answers are those systems' output, not our statements of fact or opinion about any company;
• is information only, not commercial, legal or other professional advice, and must not be relied on as the sole basis for any decision; and
• carries no guarantee of any outcome, and none is implied by any figure in it.

Free Reports are provided free of charge, "as is" and without warranty. You may use a Free Report within your organization. You may not publish it, or present it as our endorsement or assessment of any company, without our written permission. We may decline to provide a Free Report, or withdraw one, for any reason.

3. Published Research

We publish research on how answer engines respond to buyer questions, including our B2B AI Citation Index. It names companies and products as they appear in the answers we measured, applies the same stated method to every company measured, and states that we provide paid services to some companies in the categories we measure. Inclusion, omission or ranking reflects what third-party systems returned on the dates stated, not our endorsement or criticism of any company. Our research is offered in good faith, is not a representation about any company's present or future results, and may be superseded. If you believe a figure is wrong, please write to hello@shortlistaio.com and we will review it.

4. Intellectual Property

The Site and its contents are owned by us or our licensors. You may quote our published research, including individual figures and short excerpts, with attribution to Shortlist AIO and a link to the source, provided that you do not alter the figures or present them as current after we have superseded them. Otherwise, you may not reproduce, republish or create derivative works from the Site without our written permission.

Third-party names and marks, including ChatGPT, Claude, Perplexity and Gemini and the names of the vendors we measure, belong to their owners and are used only to identify their products. Their appearance does not imply any affiliation with, sponsorship by or endorsement from those owners.

5. Third-Party Links

Links to third-party sites are provided for convenience. We do not control those sites and are not responsible for their content, accuracy or practices.

6. Disclaimer and Liability

6.1 The Site, Free Reports and our published research are provided "as is" and "as available". We disclaim all warranties and conditions, whether express, implied or statutory, including any as to merchantability, fitness for a particular purpose, non-infringement, accuracy and uninterrupted availability.

6.2 To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill or data, arising from your use of the Site, a Free Report or our published research.

6.3 Our total aggregate liability arising from the Site, Free Reports and our published research is limited to CAD 100.

6.4 Nothing in these terms limits liability that cannot be limited by law, including liability for fraud. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

7. Privacy

Our Privacy Policy explains how we handle personal information. It describes our practices and is not part of these terms.

8. Changes

We may change these terms by posting an updated version on the Site with a new effective date. The version in effect when you use the Site or a Free Report applies to that use.

9. Governing Law

These terms are governed by the laws of the Province of Manitoba and the federal laws of Canada applicable there. You agree that the courts of Manitoba have exclusive jurisdiction over any dispute about the Site, a Free Report or our published research, subject to any mandatory consumer protection right you have in your place of residence. We may seek injunctive relief in any court of competent jurisdiction to protect our rights.

10. General

If any part of these terms is unenforceable, the rest remains in effect. Our failure to enforce any part of these terms is not a waiver. These terms are the entire terms between you and us for your use of the Site, Free Reports and our published research.
